BRIGAZO CUSTOMER TERMS AND CONDITIONS

Welcome to BRIGAZO.

These Terms and Conditions ("Terms") govern your access to and use of the BRIGAZO website, mobile applications, and all related services (collectively referred to as the "Platform").

By accessing, browsing, registering an account, or purchasing products through BRIGAZO, you agree to be legally bound by these Terms. If you do not agree with these Terms, you should not use the Platform.

BRIGAZO reserves the right to amend these Terms at any time. Any amendments shall become effective immediately upon publication on the Platform.

1. ABOUT BRIGAZO

BRIGAZO is an online multi-vendor marketplace that connects customers with independent sellers offering products across various categories.

BRIGAZO currently operates within Nigeria while facilitating selected international shipments, including products sourced and shipped from the United Kingdom into Nigeria. As BRIGAZO expands, services may become available across Africa and internationally.

BRIGAZO acts primarily as a marketplace and technology platform. Unless expressly stated otherwise, BRIGAZO is not the manufacturer, importer, distributor, or owner of products listed by independent vendors.

2. ELIGIBILITY

To use BRIGAZO, you must:

  • Be at least 18 years old; or

  • Have permission from a parent or legal guardian if you are under 18 years of age.

  • Have the legal capacity to enter into binding contracts.

By using the Platform, you warrant that all information you provide is accurate and complete.

3. CUSTOMER ACCOUNT

To purchase products, you may be required to create an account.

You agree to:

  • Provide accurate information.

  • Keep your login credentials secure.

  • Maintain updated contact information.

  • Accept responsibility for all activities conducted through your account.

BRIGAZO shall not be liable for losses resulting from unauthorized access arising from your failure to safeguard your account.

4. PRODUCTS

Products listed on BRIGAZO are supplied either by BRIGAZO or by independent vendors.

Although BRIGAZO endeavors to ensure accurate product descriptions, specifications, colours, images, and pricing, we do not guarantee that every listing is entirely free from errors.

Actual product colours may vary depending on your display device.

Product availability is subject to stock levels.

5. MARKETPLACE RESPONSIBILITY

Where products are sold by independent vendors:

  • The vendor is responsible for product quality.

  • The vendor is responsible for product authenticity.

  • The vendor is responsible for warranties offered.

  • The vendor is responsible for lawful sale of products.

BRIGAZO may assist in resolving disputes but does not guarantee the performance of independent vendors.

6. PRICING

All prices displayed are quoted in Nigerian Naira (NGN) unless otherwise stated.

For international products, prices may include or exclude:

  • Shipping charges

  • Customs duties

  • Import levies

  • Taxes

  • VAT

  • Port handling charges

Customers remain responsible for any government-imposed duties not expressly included during checkout.

Prices may change without prior notice.

7. PAYMENTS

Payments may be made through approved payment gateways provided on the Platform.

By making payment, you confirm that:

  • You are authorized to use the payment method.

  • The information supplied is accurate.

  • Funds are available.

BRIGAZO reserves the right to cancel any transaction suspected of fraud.

8. ORDER ACCEPTANCE

After placing an order, you will receive an order confirmation.

Receipt of confirmation does not constitute acceptance.

Orders become binding only after:

  • Payment has been successfully verified.

  • Stock availability has been confirmed.

  • The order has been processed.

BRIGAZO reserves the right to reject or cancel any order for any lawful reason.

9. SHIPPING

BRIGAZO delivers throughout Nigeria and may facilitate shipments from the United Kingdom and other countries into Nigeria.

Delivery times are estimates only.

Factors affecting delivery include:

  • Customs inspections

  • Import clearance

  • Weather conditions

  • Public holidays

  • Transportation delays

  • Security situations

  • Vendor processing times

BRIGAZO shall not be liable for delays beyond its reasonable control.

10. INTERNATIONAL SHIPMENTS

Products shipped from outside Nigeria may be subject to:

  • Customs inspections

  • Import regulations

  • Government restrictions

  • Additional taxes

  • Import duties

  • Clearance delays

Customers are responsible for ensuring imported products comply with Nigerian laws.

BRIGAZO shall not be liable where customs authorities delay, seize, or reject imported goods.

11. DELIVERY

Customers must provide accurate delivery information.

Where incorrect addresses are supplied:

  • Additional delivery charges may apply.

  • Delays may occur.

  • Orders may be cancelled.

Risk passes to the customer upon successful delivery.

12. RETURNS

Eligible products may be returned within the period specified in BRIGAZO's Returns Policy.

Products must generally be:

  • Unused

  • Undamaged

  • In original packaging

  • Accompanied by proof of purchase

Certain items may not be eligible for return, including:

  • Perishable goods

  • Personal care products

  • Customized items

  • Digital products

  • Gift cards

  • Intimate apparel where hygiene restrictions apply

13. REFUNDS

Approved refunds shall be processed using the original payment method where possible.

Refund timelines depend upon:

  • Payment provider

  • Banks

  • Card issuers

  • International payment processing

Shipping charges are generally non-refundable unless required by law.

14. CANCELLATION

Customers may request cancellation before dispatch.

Once an order has been shipped, cancellation may no longer be possible.

BRIGAZO does not independently guarantee manufacturer warranties.

17. CUSTOMER REVIEWS

Customers may submit reviews provided they:

  • Are respectful.

  • Are based on genuine experiences.

BRIGAZO reserves the right to remove misleading, offensive, or unlawful reviews.

18. INTELLECTUAL PROPERTY

All Platform content, including:

  • Logos

  • Graphics

  • Images

  • Software

  • Designs

  • Text

  • Trademarks

remain the property of BRIGAZO or its licensors.

No content may be reproduced without written permission.

19. PRIVACY

Customer information is processed in accordance with BRIGAZO's Privacy Policy.

By using the Platform, you consent to the collection, processing, and storage of personal information as described therein.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, BRIGAZO shall not be liable for:

  • Indirect losses

  • Consequential damages

  • Lost profits

  • Business interruption

  • Data loss

  • Delays caused by third parties

  • Customs actions

  • Government restrictions

  • Vendor misconduct

Where liability cannot legally be excluded, BRIGAZO's liability shall be limited to the purchase price paid for the relevant product.

21. FORCE MAJEURE

BRIGAZO shall not be liable for failure to perform obligations resulting from events beyond its reasonable control, including:

  • Natural disasters

  • War

  • Civil unrest

  • Pandemics

  • Government actions

  • Labour disputes

  • Internet failures

  • Power outages

  • Transportation disruptions

22. INDEMNITY

You agree to indemnify BRIGAZO, its directors, employees, affiliates, and partners against claims arising from:

  • Breach of these Terms.

  • Fraudulent conduct.

  • Violation of applicable laws.

  • Misuse of the Platform.

23. SUSPENSION OF ACCOUNTS

BRIGAZO may suspend or terminate customer accounts where there is:

  • Fraud

  • Abuse

  • Illegal activity

  • Repeated policy violations

  • Threats against staff or vendors

24. GOVERNING LAW

These Terms shall be governed by the laws of the Federal Republic of Nigeria.

As BRIGAZO expands internationally, certain transactions may also be subject to applicable foreign consumer protection laws where required.

25. DISPUTE RESOLUTION

The parties shall first seek to resolve disputes through good-faith negotiations.

Where resolution cannot be reached, disputes shall be submitted to mediation before litigation where permitted by law.

Any legal proceedings shall be brought before the competent courts of Nigeria unless otherwise required by applicable law.

26. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

27. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Shipping Policy, Refund Policy, and any other policies published by BRIGAZO, constitute the entire agreement between BRIGAZO and its customers.
